GENERAL TERMS AND CONDITIONS OF SALE - EFFECTIVE SEPTEMBER 1, 2024
1. Purpose
These General Terms and Conditions of Sale (GTC) govern the contractual relationship between Kidioma and its customers (legal representatives) regarding the registration and participation of children in English and/or French workshops.

3. Registration and Acceptance of the GTC
Registration for a workshop implies unconditional acceptance of these GTC. All registrations are made through the form sent in paper format or by email to the legal representatives who request it, and are confirmed by an email from Kidioma. Registrations can be made at any time during the year. In such cases, the legal representatives will pay pro rata until the end of the Kidioma course. Children can receive a free trial class that will not be charged.
4. Services
The workshops are intended for children aged 3 to 9 years and are conducted in small groups of 3 to 5 children by a tutor from an English- or French-speaking country. Legal representatives can choose the language of the workshop: French or English. The workshops can take place during lunch hours or after school, according to the conditions and availability for such organization. The group will exist from 3 enrolled children. There is a minimum of one hour per week per workshop and per enrolled child. In total, each child will benefit from at least 1 hour (60 minutes) per week over a period of 10 months. The schedules and locations of the workshops are specified during registration, depending on the availability of Kidioma and its tutors at the time of registration. Kidioma commits to making every effort to hold the workshop as close as possible to the school attended by the children. Groups may be mixed by age, with up to two groups: 3 to 6 years and 6 to 9 years. Legal representatives can choose to have their child picked up from school and accompanied to the workshop location with the other children in the group. In any case, legal representatives must provide a snack or lunch (depending on the time of the workshop). Regarding special courses/camps (during school holidays), their duration and price will be determined on a case-by-case basis, depending on needs.
5. Fees and Payment Methods
The workshop fees are indicated on the website: our services. Payment is made via bank transfer or Bizum transfer, according to the following modalities:
Annual or quarterly subscription
Monthly payment (on the 1st of each month, except September - on the 9th, and January - on the 9th as well), quarterly (September 9th, January 9th, April 9th), annual (in one payment) Payments must be made before the start of the first workshop the child will attend. The fees indicated for the workshops include the applicable VAT according to current Spanish legislation. Any change in the VAT rate will be automatically reflected in the prices of the services offered by Kidioma. Special courses or camps must be paid in full in one payment, by bank transfer or Bizum.
6. Cancellation and Refund
Customer cancellation: Any cancellation must be notified in writing to Kidioma at least 24 hours before the start of the workshop to be eligible for a refund of the missed session. After this period, no refund will be made. Kidioma cancellation: In case of cancellation of the workshop by Kidioma, the amounts paid will be fully refunded. We do our best to maintain tutor consistency, so that children get used to the same person, and for logistical reasons related to school pickup. However, a tutor may be absent, in which case they will be replaced to lead the workshop if it is possible to notify at least 24 hours before the workshop. Otherwise, the workshop will be canceled and rescheduled for a later date. Legal representatives will always be informed in case of a tutor’s absence. It is possible to obtain a refund for special courses or camps during school holidays if the cancellation is made more than 15 calendar days in advance by registered mail with acknowledgment of receipt. After this date, no refunds will be made. A full refund can be obtained within the limits of the withdrawal right described in the following section (7). Additionally, it is possible to request a refund for the remaining classes not taken if the subscription is annual or quarterly (and has already started), but only in case of relocation. In such cases, legal representatives must send a letter by registered mail with acknowledgment of receipt, certifying that they have moved (Kidioma, Calle Quero, 15, 6D, 28024 Madrid). In all cases, all refunds will be made as soon as possible after receiving the request letters sent by the legal representatives by mail.
7. Right of Withdrawal
Legal representatives have the right to withdraw from the contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days from the day the contract is concluded. To exercise the right of withdrawal, you must notify your decision to withdraw from the contract through an unequivocal statement (e.g., a letter sent by registered mail with acknowledgment of receipt). You can request the withdrawal form template if necessary, although its use is not mandatory.
8. Late Payments
In case of late payment by the customer, Kidioma may suspend all ongoing services, without prejudice to any other course of action. Additionally, Kidioma will apply late payment penalties set at 2 times the legal monthly interest rate, payable the day after the payment date indicated on the invoice, without the need for a reminder. Additionally, a fixed compensation for collection costs of 40 euros will be charged.
9. Liability
Kidioma makes every effort to ensure the safety and well-being of children during the workshops. However, Kidioma is not liable in case of:
Accident occurring outside workshop hours.
Loss or damage to children's personal belongings.
Delays by legal representatives or persons designated by them in picking up their children at the end of the class. Kidioma reserves the right to charge 9 euros for every 15 minutes of delay by parents or the person picking up their child, beyond the first 15 minutes of delay from the end of the workshop. Moreover, legal representatives must take out civil liability insurance for their child(ren) enrolled in Kidioma workshops (workshops during the school year or special courses or camps). Finally, each party will be responsible for the damages it may cause to the other party in the execution of these GTC. In any case, the service provider's liability will be limited, all other heads of damage and claims taken together and unless specifically provided otherwise, to the amount invoiced for the services.
10. Confidentiality, Data Protection, and Image Rights
Customers' personal data are processed in accordance with current regulations (GDPR). The collected information is intended exclusively for Kidioma and will not be shared with third parties without prior consent. The information collected by Kidioma will be used for the strict management of its activity. It will be permanently deleted in accordance with the applicable regulations at the time of its use, in accordance with the European Regulation on the protection of personal data EU 2016/679. Under no circumstances will data be transferred outside the EU. The customer may, in accordance with the European Regulation on the protection of personal data EU 2016/679 (GDPR), exercise their right of access to data concerning them, rectification, deletion, request the limitation of processing, object to it or request its portability by contacting: info@kidioma.es. Kidioma is authorized, unless otherwise decided by the legal representatives when filling out the registration form, to take photos or film the children during group activities for the sole purpose of posting them on the Kidioma website or on the company's main communication channels or social media. Any refusal or limitation of such posting must be mentioned in the registration form.
11. Applicable Law and Jurisdiction
These GTC are subject to Spanish law. The language of these GTC is Spanish. In case of dispute, the parties agree to seek an amicable solution before resorting to the competent courts of Madrid.
12. Complaints Handling - Customer Service
The customer can contact Kidioma for any complaint at the following email address: info@kidioma.es or by mail to the address indicated in the preamble of these GTC. We will do our best to respond as soon as possible after receiving your letter or email.
13. Modification of the GTC
Kidioma reserves the right to modify these GTC at any time. Customers will be informed of the changes by email. The new GTC will apply to all new registrations made after the modification date.
